Types of Trademarks

The two most common types of trademarks are federal and state. Federal marks are registered with the United States Patent and Trademark Office (USPTO) and provide nationwide protection for your trademark. State marks, on the other hand, offer protection only within the state in which they are filed.

The Trademark Registration Process

Registering a trademark in the United States can be a complex process and it is important to understand the various steps involved. Generally, the trademark application process involves five steps:

  1. Trademark Search: The first step is to conduct a comprehensive trademark search for existing trademarks that might conflict with your proposed mark. A comprehensive search should be performed to determine whether any existing marks might create a likelihood of confusion with your own mark.
  2. Prepare a Trademark Application: Once you have determined that there are no preexisting marks that would be confused with yours, you will need to prepare an application for registering a trademark. This application must include all relevant information about your trademarks such as their name, description, date of use, list of goods or services associated with it, and other pertinent information.
  3. Submit Application and Fee Payment: After completion of the application and payment of the filing fee (typically $275–$400 depending on how many classes of goods or services you are registering for), your application will be submitted to the United States Patent and Trademark Office (USPTO).
  4. Examination Process: Once submitted, your application will go through an examination process which includes a thorough review by a USPTO attorney to ensure compliance with all requirements related to trademarks. During this process, they may request more information or make objections if they find any issues with your application before granting approval of your trademark registration request.
  5. Publication in Official Gazette: If approved by the USPTO attorney during their examination process, then your trademark will go through a period where it is published in the Official Gazette; this allows other parties to raise any objections they may have to your registration within three months before final approval is granted. If no objections are raised during this period then final approval is granted and you receive notice from the USPTO that your mark has been registered.

Once you have registered your trademark, it is important to monitor and enforce its use. Trademark infringement occurs when someone uses a mark that is confusingly similar to the one you have registered. If this happens, you have legal recourse and can take action against the infringing party.
